General Terms and Conditions

Placing an order online requires the acceptance of the General Terms and Conditions below, which you may do during registration or in the course of the purchasing process. If you do not agree with the conditions set out in these GTC, please contact Platán Patika Limited Liability Company, the operator of the webshop, at the contact details provided, prior to placing your order.

1. Operation of the webshop

By placing an order for products available on the webshop at http://www.zue.hu/ (hereinafter “webshop”), the person placing the order (“Customer”) automatically accepts these General Terms and Conditions (“GTC”) and acknowledges them as binding. Acceptance of the GTC is a prerequisite for placing an order and entering into a contract via the webshop.

If the Customer does not wish to accept the conditions set out in the GTC, they are entitled to contact the Service Provider’s customer service instead of placing an order via the webshop, where they will be informed of other available contracting options.

The webshop has been developed with services and features aimed at helping our customers find and purchase the desired products as easily as possible. The functions of the store have been adjusted primarily to needs that may also arise during personal purchases. We aim to provide the maximum amount of information to assist you in selecting products. You may browse products without registration, and you may select and place items into your cart. Products are organised into categories and subcategories to facilitate searching. Clicking on any product category provides a detailed product list from which you can choose and access product information pages. Each product displays its name, price, packaging, any discount, a photo of the product—this may differ from the delivered product box if the manufacturer has changed the packaging—and a short description of its primary characteristics. The detailed description contains the patient information leaflet in the case of medicines, or the product description for other items. The search bar allows searching by full words or partial terms.

2. Essential characteristics of the subject of the contract

The webshop allows the ordering of medicines registered in Hungary that are available without prescription and not publicly funded*, medicinal products, homeopathic complex remedies, dietary supplements, other health-related or dietary food products, medical devices**, cosmetics, and other items (hereinafter “Products”). Before using any over-the-counter medicine or non-medicinal health product purchased, please consult your GP or pharmacist. Self-diagnosis and incorrect medication may cause adverse side effects. Always read the instructions for use or the patient information leaflet of the ordered product before using it, and please follow the recommended dosage. Consult your doctor before prolonged use of any medication.

Information found on the website originates from external sources (manufacturer, distributor, others). The operator of the webshop assumes no responsibility for these, nor for any issues or damages arising from the use of such information.

In the case of medicines and dietary supplements, according to pharmacy regulations, only products with an expiry date that ensures usability within the expiry period under minimum dosage may be sold.

The product descriptions available on the product pages are for informational purposes only and may not include all information on the product. For the official product description, please visit the manufacturer’s website.

In accordance with Section 17 (6) of Decree 41/2007 (IX.19.) of the Ministry of Health, the list of pharmacies authorised for online medicine sales is maintained and published by the National Institute of Pharmacy and Nutrition (OGYÉI) at the following link:

3. Ordering process

Only a legally competent natural person may act as Customer in their own name, or as a representative of a legal entity or organisation without legal personality. Over-the-counter and non-publicly-funded medicines*, medicinal products, and homeopathic complex remedies may be ordered only by persons over 18 years of age.

Orders may be placed exclusively through the Platán Patika webshop, either with or without registration. The system sends an email confirmation of successful registration and the username provided.

After registration, billing and shipping information may be entered under the Account/Modify address details menu. By default, billing and shipping details are considered identical, but may be changed during ordering.

Placing an order

The Customer may browse the webshop without placing an order, and may review the Products. Each Product displays its name, price, packaging, any discount, description, and a photo. The Service Provider assumes no responsibility if the photo differs from the actual packaging.

After adding a product to the cart, the Customer may continue shopping or proceed to checkout. At checkout, the Customer may specify additional shipping/billing addresses, choose payment methods, and leave comments regarding delivery.

Prices shown in the webshop exclude shipping fees. The final amount payable may be reviewed in the Total section at the end of the order. Prices represent current offer prices and may change until the order is processed.

The Customer may add products to the cart by clicking “Order”. The cart contents and total price can be monitored at all times in the top menu.

By clicking the cart icon, the Customer may review the summary of the order (product names, quantities, prices, and shipping fee). Before submitting the order, the Customer may modify the cart and click “Update cart”.

After checking the cart, the Customer clicks “Proceed to checkout”. On the “Checkout” page, the Customer must:

– Enter any discount coupon or referral card number into the discount code field.
– Complete billing details, and if different, tick “Ship to a different address” and provide shipping details.
– Indicate delivery-related requests in the “Notes” field. The Service Provider will attempt to fulfil these but assumes no responsibility for doing so.
– Review the products, prices, quantities, and shipping fees. If changes are required, click “View cart”.
– Choose a payment method: direct bank transfer; bank card; cash-on-delivery (cash or card); or personal pickup. If paying by card upon cash-on-delivery, the Customer must indicate this in the “notes”. Fraud-prevention services may restrict available payment options based on automated decision-making from the following: cash-on-delivery, bank card, transfer.
– Accept the GTC by ticking the relevant box, then click “Confirm order”.

Gifts are always invoiced at 1 HUF regardless of their value.

After submitting the order, an on-screen notification appears, and an email confirmation is sent within 72 hours to the email address provided. This automatic confirmation records acceptance by the Service Provider but does not specify a delivery date. If the confirmation email does not arrive within 48 hours, the Customer is released from their contractual obligation.

If the Service Provider later finds that certain Products are out of stock, they will notify the Customer via email or phone on the next business day. In such cases, (i) either party may withdraw from the contract regarding the unavailable items, or (ii) agree by email on a later delivery date.

The Customer may modify the order on the day it was placed via email to info@zue.hu, provided that delivery has not yet begun.

If the Customer has placed multiple consecutive orders and wants them shipped together, they may request this via email, although the Service Provider assumes no responsibility for fulfilling the request.

The contract between Customer and Service Provider is concluded upon the Service Provider’s confirmation of the order, which is communicated in a “Confirmed” status email after processing begins.

The contract is considered a written contract, which the Service Provider records and archives. Orders and concluded contracts can be accessed in the Customer’s account. The contract is concluded in Hungarian; contracting in other languages is not possible.

The Service Provider may immediately delete a Customer’s registration and withdraw from confirmed orders if it has reason to believe the Customer has breached these GTC or intends to use the webshop fraudulently.

Payment

Bank card payment
You agree that Platán Patika Kft. (6722 Szeged, Mérey u. 15/B.) may transfer your personal data stored in the www.zue.hu user database to SIX Payment Services (Europe) S.A. (L-5365 Munsbach, 10, rue Gabriel Lippmann) as data processor. Transferred data: title, surname, first name, IP address, billing address, shipping address, phone number, email address, last four digits of bank card number. Purpose: to facilitate communication between merchant and payment provider systems and ensure traceability of transactions.

Cash-on-delivery
For cash-on-delivery, the product price, shipping fee, and cash handling fee must be paid to the courier upon delivery, who provides a receipt. Fees:
– 459 HUF up to 49,999 HUF
– 699 HUF from 50,000 to 99,999 HUF
– 1,899 HUF above 100,000 HUF
The webshop reserves the right to restrict cash-on-delivery for Customers who previously failed to accept orders, based on the COD-checker and internal database.

The COD fee must be paid to the courier or at the pickup point/parcel machine upon receiving the package.

Payment via health insurance fund
Direct payment by health fund card is not possible, but if the Customer enters the fund’s name, address, member ID, and card number in the billing notes, a health fund invoice can be issued.

Some Products are reimbursable by health insurance funds. For this, the fund’s name and address must be entered, and the member ID must be added in the notes field. The Customer may claim the amount back from their fund afterward.

If paying by card or bank transfer, payment must be completed within 24 hours; otherwise, the order is cancelled.

The Service Provider confirms receipt of orders electronically. Failure to receive confirmation within 48 hours releases the Customer from contractual obligations.

Orders submitted via the webshop constitute legal declarations made by implied conduct (clicking an icon), not written declarations.

Orders are archived electronically for five years. At the Customer’s request and with the order number, the order record will be provided.

The contract language is Hungarian.

Forgotten password
Under “Login”, click “Forgot password”, enter your email address, and a new password will be sent.

4. Shipping

4.1 Shipping methods

Any shipping address within Hungary may be provided. The shipping address may differ from the billing address. Once provided, the shipping address cannot be modified. If the Customer wishes to ship outside Hungary, they must contact customer service instead of ordering via the webshop. Prescription medicines cannot be shipped abroad.

Shipping options:

– Home delivery via carrier (MPL, GLS, DPD)
– Pickup at Post Office
– Delivery to PostaPont (MOL stations, COOP stores) or GLS parcel shops
– Pickup at MPL or GLS parcel machines

Maximum parcel weight: 10 kg. Heavier orders must be picked up personally at Platán Patika (6722 Szeged, Mérey u. 15/B).

Delivery-related notes may be added and will appear on the delivery label.

4.2 Delivery time

For in-stock items ordered by 12:00, delivery is expected the next business day, but no later than three business days after the order. Orders placed after 12:00 may take up to four business days.

Orders placed on non-business days (weekends, holidays) are processed on the next business day.

The Service Provider delivers through an authorised courier service. Prescription or publicly funded medicines cannot be delivered.

Deliveries occur on business days between 8:00 and 17:00.

Under Decree 44/2004 (IV.28.) ESzCsM, medicines may not be delivered to persons under 14. If such a product is ordered, and the Customer is unavailable, a written authorisation must be provided to a person over 14, who must present ID to the delivering pharmacist or pharmacy assistant.

4.3 Personal pickup

Platán Patika (6722 Szeged, Mérey u. 15/B) is the exclusive pickup point. Delivery times remain the same as above: orders placed by 12:00 will be ready within three business days; later orders within four.

Orders are confirmed by email.

Payment upon pickup is not possible; orders must be prepaid.

4.4 Shipping costs

Shipping fees for webshop orders:

– Free delivery for orders of 28,000 HUF or above via MPL courier
– 999 HUF for MPL parcel machine
– 1,099 HUF for GLS parcel machine
– 1,299 HUF for GLS ParcelShop
– 1,399 HUF for Post Office or postal pickup
– 1,499 HUF for MPL PostaPont
– 1,699 HUF for MPL home delivery
– 1,999 HUF for DPD home delivery
– 1,999 HUF for GLS home delivery

No minimum order amount is required.

Products marked separately or weighing 0.5 kg or more, or fragile items, may incur higher shipping fees or be excluded from certain delivery methods. The webshop system automatically calculates all available shipping options and fees during checkout.

Shipping fees also apply to orders shipped after partial cancellation due to unavailable items. If cancellation reduces the order value below the free-shipping threshold, delivery charges apply.

If the Customer provides an incorrect or incomplete shipping address, the Service Provider is not liable for failed delivery. In such cases, the courier returns the package to the Service Provider, who contacts the Customer via email or phone. If the Customer wishes the package to be resent, the new shipping fee must be paid in advance. If the Customer does not request reshipment, the order is cancelled and the amount paid—minus incurred shipping costs—is refunded.

5. Right of withdrawal

The Customer may withdraw from the contract without justification within 14 calendar days of receiving the Product. The withdrawal deadline expires 14 days from the day when the Customer—or a third party other than the courier and indicated by the Customer—takes possession of the Product.

To exercise the right of withdrawal, the Customer must send a clear statement of intent (e.g. by post or email) to the Service Provider at the contact details provided in these GTC, before the withdrawal deadline expires.

The Customer exercises the right in due time if the notice is sent before the 14-day deadline.

Effects of withdrawal

If the Customer withdraws from the contract, the Service Provider refunds all payments received—including shipping costs (except for additional costs resulting from choosing a shipping method more expensive than the standard cheapest option offered)—without delay and no later than 14 days after receiving the Customer’s withdrawal notice.

The refund will be made via the same payment method the Customer originally used, unless the Customer has expressly agreed otherwise; in any case, the Customer will not incur additional fees as a result.

The Service Provider may withhold the refund until the returned Product is received or the Customer has provided credible proof of return, whichever occurs first.

The Customer must return the Product without undue delay, but no later than 14 days from the date of the withdrawal notice. The deadline is considered met if the Customer sends the Product before the 14-day period expires.

The direct cost of returning the Product is borne by the Customer. Cash-on-delivery returns are not accepted under any circumstances.

The Customer is liable for any diminished value of the Product resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the Product.

Certain products are exempt from the right of withdrawal under Government Decree 45/2014 (II.26.)—for example:

– Sealed products that cannot be returned after opening for health or hygiene reasons
– Products that deteriorate or expire rapidly
– Medicines and medical devices sold online (if the packaging has been opened)

These items cannot be returned once opened.

6. Warranty and guarantee

For defective performance, the Customer may assert warranty claims according to the rules of Act V of 2013 (Civil Code) and Government Decree 19/2014 (IV.29.) NGM.

Implied warranty

In case of faulty performance by the Service Provider, the Customer may assert implied warranty claims. The Customer may request repair or replacement unless the chosen remedy is impossible or would result in disproportionate additional costs. If neither repair nor replacement is possible, the Customer may request a proportional reduction in price or withdraw from the contract.

A defect discovered within six months of delivery is presumed to have existed at the time of delivery unless the presumption is incompatible with the nature of the defect or Product.

The Customer must report the defect within two months of its discovery.

Implied warranty claims expire two years from delivery.

Product warranty

For defective Products, the Customer may assert a product warranty claim against the manufacturer or distributor. Only repair or replacement may be requested. The manufacturer is released from warranty if:

– The Product was not manufactured or marketed within its business activities
– The defect was not detectable according to scientific and technical knowledge at the time of placing the Product on the market
– The defect results from compliance with mandatory regulations

Product warranty claims expire two years after the Product is placed on the market.

Commercial guarantee

Certain Products include a statutory commercial guarantee; in such cases, the Service Provider provides the guarantee conditions as specified in the relevant regulation or manufacturer’s documentation.

The Service Provider assumes no responsibility for defects resulting from improper storage, handling, or use, or from misuse of medicines or health products.

7. Liability

The Customer uses the webshop at their own risk. The Service Provider is not liable for damages arising from unavoidable external causes (e.g. technical failures, system outages, network disruptions, software or hardware errors). The Service Provider is not liable for damages resulting from incorrect product use or failure to follow patient information leaflets or instructions for use.

The Service Provider is not responsible for any damages caused by the Customer providing incorrect data, using another person’s data unlawfully, or failing to keep login information confidential.

The Service Provider excludes liability for third-party conduct, including courier services, unless otherwise required by law.

8. Privacy and data processing

The Service Provider manages personal data provided during registration and order placement in accordance with its Data Protection Notice and the applicable legislation, particularly Regulation (EU) 2016/679 (GDPR).

Personal data are used solely for order processing, delivery, invoicing, and customer communication. Data may be transferred to courier services and payment processors strictly for operational purposes.

The Customer may request access, rectification, deletion, restriction of processing, portability, or may object to processing. Complaints may be submitted to the National Authority for Data Protection and Freedom of Information (NAIH).

9. Complaint handling

Customer complaints may be submitted in writing by post or email to the Service Provider's contact details.

The Service Provider investigates all complaints and provides a written response within 30 days.

If the Customer is not satisfied, they may turn to the competent conciliation board. The Service Provider participates in the conciliation procedure.

10. Miscellaneous provisions

Hungarian law governs the contract and any disputes. The competent court is the Service Provider’s registered-office court unless mandatory rules provide otherwise.

The Service Provider may amend the GTC unilaterally. Amendments apply to orders submitted after the effective date.

If any provision of the GTC becomes invalid, the remaining provisions remain in force.

11. Intellectual property rights

All content displayed on the webshop—including images, descriptions, product information, graphics, logos, software, layout, and text—is protected by copyright. Any use, reproduction, distribution, or modification of these materials without the explicit prior written permission of the Service Provider is prohibited.

The Customer may not download, store, or print the content of the webshop except for personal, non-commercial use directly related to browsing or ordering Products. Any unauthorised use may result in civil or criminal liability.

The Customer may not use any automatic device, software, or algorithm to access, monitor, copy, or retrieve any part of the webshop without prior written permission.

12. Technical conditions

The Customer is responsible for ensuring the technical conditions necessary for using the webshop—such as an internet connection and appropriate software and hardware.

The Service Provider strives to ensure continuous, uninterrupted operation of the webshop. However, maintenance, updates, or unforeseen technical issues may temporarily limit or suspend access.

The Customer acknowledges that the Service Provider is not liable for any loss resulting from technical interruptions, system outages, data transmission delays, viruses, or other harmful components if these occur due to circumstances beyond its control.

If system updates or maintenance are planned, the Service Provider will notify Customers on the webshop interface when possible.

13. Security provisions

The Customer is responsible for safeguarding their login information and must ensure that unauthorised persons cannot access their account. Any activity performed through the Customer’s account is considered to have been performed by the Customer.

If the Customer suspects unauthorised access or misuse of their account, they must inform the Service Provider immediately.

The Service Provider applies industry-standard security measures to protect personal data and transactions. However, the Customer acknowledges that full protection on the internet cannot be guaranteed.

Online bank card payments are processed through secure, encrypted channels provided by the authorised payment processor.

14. Force majeure

Neither party is liable for failure to perform obligations if caused by force majeure—events unforeseeable, unavoidable, and beyond the reasonable control of the parties.

Examples include: natural disasters, war, terrorism, riots, government restrictions, pandemics, strikes, power outages, failures of telecommunication networks, or interruptions of supplier services.

If force majeure occurs, the affected party must notify the other without delay and take all reasonable steps to mitigate the consequences.

If the force majeure event lasts longer than 30 days, either party may withdraw from the contract without penalty.

15. Termination of registration

The Customer may request the deletion of their webshop account at any time by contacting customer service. The Service Provider will process the request within a reasonable timeframe, provided that there are no outstanding orders or legal retention obligations.

The Service Provider is entitled to delete a Customer’s account immediately if the Customer:

– uses the webshop unlawfully or fraudulently
– repeatedly provides incorrect data
– violates the GTC
– attempts to interfere with the webshop’s operation
– abuses promotions or discount systems

Deleting an account does not affect the validity of previous orders or legal obligations.

16. Electronic communication

The Customer agrees that the Service Provider may communicate electronically—via email or messages displayed on the webshop interface—regarding registration, ordering, payment, shipping updates, or modifications to these GTC.

Electronic messages are considered delivered when they become accessible to the Customer.

The Customer must ensure that emails from the Service Provider do not end up in spam or blocked folders.

17. Governing language and legal framework

The language of the contract is Hungarian. The English translation of these terms (if provided) is for informational purposes only; in case of discrepancies, the Hungarian version prevails.

The contractual relationship is governed by Hungarian law, particularly:

– Act V of 2013 on the Civil Code
– Government Decree 45/2014 (II.26.) on contracts between consumers and businesses
– Act CVIII of 2001 on electronic commerce
– GDPR (Regulation (EU) 2016/679)

Any disputes arising from the contract shall be submitted to the competent Hungarian court, unless binding provisions provide otherwise.

Data Privacy Notice

The purpose of this Privacy Notice is to set out the data protection and data processing principles applied by Platán Patika Kft. (hereinafter: the “Company”), as well as the Company’s data protection and data processing policy.

1. Definitions

“Personal data” means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

“Processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

“Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

“Processor” means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

“Data subject’s consent” means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

2. Data Processing Principles of Our Company

When processing personal data, our Company adheres to the following principles:

  • We process personal data lawfully, fairly, and in a manner that is transparent to you.

  • We collect personal data only for specified, explicit and legitimate purposes and do not process them in a manner incompatible with those purposes.

  • The personal data we collect and process are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

  • Our Company takes all reasonable measures to ensure that the personal data we process are accurate and, where necessary, kept up to date; inaccurate personal data are erased or rectified without delay.

  • We ensure appropriate security of personal data, including protection against unauthorised or unlawful processing, accidental loss, destruction or damage, by implementing appropriate technical and organisational measures.

Our Company processes your personal data:

  • on the basis of your prior, informed and voluntary consent, and only to the extent necessary and for specific purposes in all cases, meaning that we collect, record, organise, store and use the data accordingly;

  • in some cases, the processing of your data is based on a legal obligation and is therefore mandatory; in such cases we will draw your attention to this fact separately;

  • in certain cases, our Company or a third party has a legitimate interest in processing your personal data, for example for the operation, development and security of our website and online store.

Purpose: Registration and record-keeping of visitors, processing and fulfillment of orders, purchases, invoicing, and the legitimate interests of the Company.

Legal Basis: Consent, contract, legal obligation (GDPR Article 6(1)(c), Eker TV §13/A), legitimate interest.

Processed Data: First name, last name, full name, e-mail address, phone number, username (for registered customers), purchase data (product, quantity, price, date), IP address, time of visit, visited subpages, operating system, browser type.

Retention Period: Analytics: until deletion of registration or withdrawal of consent; Online store operation: indefinitely, but no later than withdrawal of data processing consent; Logs: 90–120 days.

Purpose of Processing: Fulfillment of contracts, delivery handling, complaint management, follow-up calls, analysis of customer habits, and customer communication.

The service provider uses fraud prevention services to determine available payment methods automatically based on feedback received. The available payment methods include: cash on delivery, bank card, and bank transfer.

3.3 Newsletter Service

Purpose: Maintaining contact and notifying you about new promotions and products.

Processed Data: Full name, e-mail address, payment-related data (payment deadline, bank account, bank or credit card number, e-wallet, cash on delivery, etc.), participation in discounts or promotions, delivery information (delivery deadline and delivery address including postal code, city, street name and type, house number, floor, door) or pickup point details, billing name and address (for natural persons: full name, tax number or tax ID if necessary for invoicing).

Retention Period: 5 years for general data, 8 years for invoices and related documents, until newsletter unsubscription.

3.4 Direct Marketing Service

Purpose: Based on analysis of your purchasing habits, we create and send personalized offers, contact you for business acquisition purposes, and provide information about products and services we sell.

Legal Basis: Consent

Retention Period: Until withdrawal of consent.

3.5 Customer Service and Complaints

Purpose: Responding to inquiries and complaints.

Processed Data: Full name, e-mail address, phone number, mailing address, other personal messages.

Legal Basis: Consent, legal obligation

Retention Period: Until withdrawal of consent or for up to 5 years.

Visitors to our website are asked to provide personal data only if they wish to register, log in, or make purchases in our online store.

Personal data provided during registration or the use of the online store cannot be linked, and identifying individual visitors is not our primary objective.

5. Use of Other Marketing Programs

5.1 Use of the Cash-on-Delivery Inspector Service by Data Controllers

Description of Data Processing:
The online store sends information about the success of product deliveries purchased by the Data Subject (order received/not received) and the Data Subject’s pseudonymized e-mail address (hashed with SHA256) to the Cash-on-Delivery Inspector service, where the Service Provider stores this data and makes it available to other online stores using the service upon manual or automated request.

Types of Data Processed:

  • Data Subject’s e-mail address

  • Number of purchases made by the Data Subject in the online store

  • Number of successfully delivered packages and packages whose delivery attempts were unsuccessful

Purpose of Data Processing:
To prevent or minimize potential damage caused by contractual breaches by the Data Subject. The website’s system automatically offers payment options based on the coded data in the Cash-on-Delivery Inspector, depending on the Data Subject’s previous order outcomes (e.g., did not receive, refused, or not ordered by the Data Subject).

Legal Basis:
Article 6(1)(f) of the GDPR – legitimate interest of the Data Controllers in reducing potential damages caused by the customer’s breach of contract.

Duration of Processing:
Data Controllers process the data for 8 years from the date of collection.

Storage of Data and Security Measures:
Data Controllers implement appropriate technical and organizational measures, taking into account the nature, scope, context, and purposes of processing, as well as the risks to the rights and freedoms of natural persons, to ensure GDPR-compliant processing. Security measures of the online store as Data Controller are described in section 5 of this Privacy Notice. The security measures of the Cash-on-Delivery Inspector are described in its own Data Security section.

How the Cash-on-Delivery Inspector Works:

Legitimate Interest Assessment:
The Data Controller has conducted a legitimate interest assessment and concluded that the legitimate interests of the Data Controllers proportionally limit the interests of the Data Subjects. The processing of personal data is necessary to protect the Data Controller’s assets and to ensure the rights of the Data Subject. No alternative, less invasive solution is available.

The Data Controller uses only the personal data already provided by the Data Subject during purchase; no additional personal data are collected. The processing is lawful, fair, and transparent.

5.2 Use of Google Analytics and Google Remarketing Programs

Visitors to the Company’s websites consent to the use of Google Analytics and Google Remarketing programs. They allow tracking and monitoring of their user behavior for the benefit of the Company and any third parties placing cookies.

Users may block or disable cookie tracking at any time as described below. Google Analytics and Google Remarketing comply fully with data protection authority requirements.

For personalized communication and offers, the Company uses S.C. The Marketer International S.R.L. (Str. Nicolae G. These activities do not have legal or significant effects on users; the profile only provides personalized discounts and marketing offers. Users may opt out without losing discounts or offers.

TheMarketer collects and stores the following personal data for profiling and interaction purposes: e-mail, phone, name, gender, address, city of birth, date of birth, order ID, county seat, discount codes and values, order values, shipping costs, product prices and variants, IP, browser, device, operating system, cookies, timestamp, visited pages, categories, brands, products, clicks, mouse actions, scrolling, adding to cart/wishlist, comments, Facebook likes, help page visits.

Visitor data is stored for 2 months; registered users’ and customers’ data for 3 years. The service uses third-party providers in the EEA and USA (for push notifications), and data transfer is based on the EU-US Privacy Shield. Data are stored only during contractual provision.

Incorrect, inaccurate, or incomplete data may prevent the use of our services.

If you provide personal data of another person, we assume that you have the necessary authorization to do so.

You may withdraw your consent to data processing at any time, free of charge, by:

  • Deleting your registration,

  • Withdrawing consent to data processing, or

  • Withdrawing consent for the processing or use of any mandatory data provided during registration or requesting its restriction.

For technical reasons, we commit to registering the withdrawal of consent within 3 days. However, please note that certain data may still be processed after withdrawal of consent to fulfill legal obligations or enforce legitimate interests (e.g., Accounting Act §169, Consumer Protection Act §17/A).

In cases of misleading personal data, or if a visitor commits a crime or attacks our system, the visitor’s registration will be terminated immediately, and their data will be deleted or, if necessary, retained for the duration required to establish civil liability or conduct criminal proceedings.

Other Purposes of Data Processing: Recording Telephone Conversations

The Company operates a customer service call center. Telephone conversations with customer service may be recorded to accurately reconstruct statements made during the call in the event of a consumer dispute.

The Data Subject is informed at the start of the call that the conversation will be recorded. This provides the user the option to decide whether they consent to the recording. If the Data Subject does not consent, they may terminate the call and contact the Company via e-mail or postal mail instead.

The Company stores the recording for 1 year from the date of the call.

If the Data Subject does not consent to the recording, the Company may not be able to resolve the complaint immediately, or in justified cases (e.g., if the Data Subject uses abusive, obscene, or offensive language toward the customer service representative or the Company), the Company reserves the right to terminate the call.

7. Direct Marketing and Newsletter Data Processing

By making a statement during registration or later modifying the personal data stored on the webshop (i.e., explicitly expressing consent), you may give your consent for your personal data to be used for marketing purposes. In such cases, until withdrawal of consent, your data may be processed for direct marketing and/or newsletter purposes, and you may receive advertising and other communications, information, offers, and/or newsletters (Act on Commerce §6).

You may provide consent for direct marketing and newsletter purposes either jointly or separately, and you may withdraw it at any time, free of charge.

Deletion of registration is always considered as withdrawal of consent. However, withdrawal of consent for direct marketing and/or newsletter purposes does not automatically constitute withdrawal of consent for data processing related to the webshop.

For technical reasons, the registration of withdrawal or cancellation of consent is handled within 3 days.
